These terms of service for IT Tech LLC (this ‘Agreement’) is a legal document stating the relationship between ‘you’ (either an entity or an individual) and the ‘company’ (IT Tech LLC). The ‘company’ will also be synonymous for all the suppliers and licensors of IT Tech LLC and all the products, subscription, packages and services offered by the company will be referred to as ‘Services’. You hereby acknowledge that you have read the terms of services carefully before proceeding on to the site. All the products and services offered by IT Tech LLC come with these Terms of Service and your acceptance of the services will be considered as an acceptance to these terms of services as well. The company doesn’t sell any product or service without the acceptance of these terms of service. It should also be noted that for availing the services of the company you are required to have a working internet connection and the company takes no responsibility of the quality and reliability of your internet service and the problems arising due to it.

All the content visible on this website including information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material ("Content") is protected by copyright, trademark, patent, or other proprietary rights; these rights are valid and protected in all forms, media, and technologies existing now or developed in the future. All Content is copyrighted as a collective work under U.S. and international copyright laws. Except as expressly authorized or licensed, you may not copy, modify, remove, delete, augment, add to, publish, or transmit; participate in the transfer or sale, lease or rental of; or create derivative works from or in any way exploit any of the Content, in whole or in part. Logos and other trademarks on the site are the property of their respective owners and are owned by, licensed to, or, where required, used with permission by the company. No one is authorized to reproduce, copy, edit or manipulate the content in any manner without the written consent of IT Tech LLC.

2. Third Party Links and Content

This site may contain third party links to other sites which may be useful for the customers. IT Tech LLC has put those links for the benefit of the customers but it doesn’t take the responsibility of the content on those websites. The company can’t be held responsible for any loss or damage occurring due to visiting those sites. The users are advised to use their own discretion. The company may not have any direct relationship with the logos and trademarks displayed on the website and their presence on the website is solely for informational, educational and reference purposes only.

3. Subscription Services

IT Tech LLC offers multiple subscription services. Subscription of these services entitles you to get 24 x 7 support from the technical support agents of the company during the period of the contract. The subscription entitles you to get support for a specific number of devices registered with the company having unique identifications. Unless specifically mentioned otherwise, no service shall be provided to other devices in the same subscription. You can call anytime during the period of contract for taking technical support for those devices.

4. Incident Services

IT Tech LLC also offers incident based service where you can ask for technical support from the company’s technical support agents in the event of any technical problem. These services will be offered as per the incident services availed by us and are meant for single service of the device. The incident will be calculated as an occurrence of defect reported by you. The experts will provide you complete technical support for that incident and help you.

5. Mode of Support

IT Tech LLC only provides support through two mediums viz. phone support and support via remote access of your device. The technical support agents will seek remote access of your device for providing technical support. However, the whole session will be recorded and monitored for safety purposes. You must agree to provide remote access of your device for the repair work to be carried out. The company will not be responsible for any data loss during the session. In case your device is not connected to the internet the experts will try to provide technical support through phone support and you will have to carry out the given instructions. In no circumstances the company will provide a home visit for repairing your device.

6. Hardware and peripherals

You must agree to the condition that in no condition the hardware issues will be covered under this agreement. If any hardware problem is discovered during the repair it will be your responsibility to get it repaired at your cost. The company does not cover any warranties for the hardware issues in your devices.

7. Resolution Time

The company would always try to resolve the technical issues within the stipulated time. However, in case of hardware issues or procedural delays the process can take some time and the company can’t be held responsible for such delays.

8. Right to modify the Terms of Use at any point of time

The company reserves the right to modify the terms of this agreement at any point of time. A notice shall be given to the existing users and all the new users are advised and encouraged to read the policy documents before subscribing to the services. All the subscriptions of the services are guided by this document and therefore it is expected from the users to go through this document before taking any service. This agreement is liable to nullify if you do not agree to the terms of use. No notice shall be given to the users for termination of contract in such cases.

Disclaimer of Warranty & Limitation of Liability.

THE SERVICES ARE PROVIDED AS-IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IT Tech LLC FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. YOU ASSUME THE ENTIRE RISK ARISING OUT OF THE USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IT Tech LLC OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SERVICES EVEN IF IT Tech LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH IT Tech LLC RELATED TO THIS AGREEMENT OR THE SERVICES/CONTENT SHALL BE CANCELLATION OF THE SERVICES. IT Tech LLC DOES NOT ENDORSE, WARRANT OR GUARANTEE ANY CONTENT PROVIDED BY OR THROUGH IT Tech LLC. THIS SERVICE DOES NOT INCLUDE ANY WARRANTIES IMPLIED OR EXPRESS FOR ANY DEVICE THAT IS UNDER COVERED UNDER THE TECHNICAL SUPPORT SUBSCRIPTION SERVICES PROVIDED BY IT Tech LLC.

Indemnification.

You agree to hold harmless, indemnify and defend IT Tech LLC, its officers, directors and employees, from and against any losses, damages, fines and expenses (including attorneys' fees and costs) arising out of or relating to any claim that you have violated any term of this Agreement, including, without limitation, the requirements set forth in this agreement.
